Compassionate Bail Application Information

For whānau of our clients who are remanded in custody

This page is for whānau of clients in prison who need urgent compassionate bail (to attend a tangi/funeral, visit someone who is very ill, or another exceptional reason).

Filling out this form does not mean bail is granted. It helps our office prepare an urgent application to the Court. The Court makes the final decision.

Supporting evidence required

The application cannot be filed without written evidence.

• For a tangi/funeral: A letter from the funeral home confirming the date, time, location and relationship of our client to the deceased.


• For serious illness/medical reasons: A letter from the hospital/GP confirming severe illness or urgent medical situation.

Please email this evidence immediately after submitting the form to office@thodeutting.com.

Driver's licence requirement

You must also arrange for a clear photo of the nominated driver's Full New Zealand driver's licence to be emailed to us.

Nominated drivers MUST hold a Full New Zealand driver's licence. If the nominated driver is our client's spouse, then they may hold a Restricted New Zealand driver's licence.

What happens next

After you submit the form and send us the required documents:


• Our office will review your information.
• A lawyer will prepare the application and file it in Court.
• The Court decides whether bail is granted and on what conditions.

If the matter is very urgent (e.g. tangi tomorrow), please also call us on 09 444 5335 immediately after submitting the form.
